These terms are a plain-English starting point, not legal advice. We’d recommend a solicitor reviews them — particularly the liability and data processing sections — before relying on them as your final published version.
1. Who these terms are between
These terms are between Darwen Pub Co Ltd (trading as PubSuite), a company registered in England and Wales under company number 16420301, with its registered office at 253 Bolton Road, Darwen, England, BB3 2PG (“PubSuite”, “we”, “us”, “our”) and the business signing up to use PubSuite (“you”, “the Venue”). By creating a PubSuite account, or by using an account created for you, you agree to these terms on behalf of that business.
2. The Service
PubSuite is a subscription booking, staff rota and clock-in system for hospitality businesses, providing your venue with its own address at yourvenue.pubsuite.app. We may add, change or remove features over time as the product develops.
3. Your account
You must give us accurate information when you sign up, and keep it up to date. You’re responsible for the accounts your business creates for its own staff, and for keeping login details secure — let us know straight away if you think an account’s been compromised.
4. Subscription, trial and billing
PubSuite is billed at £59.99 per month per venue, collected by Direct Debit through GoCardless. New venues get a 30-day free trial before the first charge — you can cancel any time during the trial with nothing charged. After the trial, your subscription renews monthly until cancelled. We’ll give reasonable notice of any price change before it applies to you.
If a payment fails, we may flag your account as past due and, if it isn’t resolved within a reasonable period, suspend access until payment details are updated.
5. Your data
You own the data you and your staff put into PubSuite — bookings, staff records, rota, and everything else specific to your business. We don’t use it for anything except providing the service to you (and, in aggregate/anonymised form only, to understand and improve PubSuite itself).
For personal data you hold about your own guests and staff, you are the data controller and we act as your data processor — processing it only on your instructions, keeping it secure, and assisting with data subject requests where we reasonably can. We run periodic backups of your data as a safety net, but this doesn’t replace keeping your own records — PubSuite includes CSV export tools for exactly this reason, and we’d encourage you to use them.
6. Acceptable use
You agree not to use PubSuite unlawfully, to attempt to access another venue’s data, to attempt to bypass or undermine the platform’s security, or to reverse-engineer the software. You’re responsible for how your own staff use the accounts you create for them.
7. Service availability
We aim to keep PubSuite available and reliable, and we’ll do our reasonable best to fix problems quickly, but we don’t currently guarantee a specific uptime service level. We’ll try to give notice of planned maintenance where practical.
8. Intellectual property
PubSuite, its software and branding belong to us. Nothing in these terms transfers any of that to you — you’re licensed to use the service for your own business while your subscription is active, that’s all.
9. Suspension and termination
You can cancel your subscription at any time; access continues until the end of the billing period already paid for. We may suspend or end your access if payment is significantly overdue, if you breach these terms, or if we reasonably believe your use puts other venues’ data or the platform’s security at risk.
When your subscription ends, your data stays available for a limited period (currently 30 days) so you can export it, after which it may be permanently deleted.
10. Liability
Nothing in these terms limits our liability where the law doesn’t allow it to be limited — for example, death or personal injury caused by our negligence, or fraud. Beyond that, our total liability to you arising out of your use of PubSuite is limited to the fees you’ve paid us in the 12 months before the claim, and we’re not liable for indirect or consequential losses (such as lost profits or lost bookings).
11. Changes to these terms
We may update these terms from time to time; the date at the top shows when it was last changed. Continuing to use PubSuite after a change means you accept the updated terms.
12. Governing law
These terms are governed by the law of England and Wales, and any dispute will be dealt with by the courts of England and Wales.
